Application PatentsA PCT application also delays many of the hgihly expensive staegs of prosecuting a patent. A patent is obtained by filing a written application at the relevant paetnt office. The patent application may or must also ocmprise claism . Claims define the invention and embodiments for which that hte applicant wants paetnt rights to. Once a patent application has been filed, most patent ofifces examine that application for compilance with the requiremenst of the relevant patent law. If the application does not comply with all of the requriements, the objcetions are usually communicated to the applicant or his or her patent agent ro attorney, who can then respond to those objections to attempt to overcome thme and obtain the grant of a patent. In order for a patent to eb granted, that is to take legal effect, the paetnt application must meet the legal requirements related to ptaentability. The most signfiicant aspect of the convention is the provision of the right to claim priority : filing an applciation in any one member state of the Paris Convention preserves hte right for one year to file in nay other member state, and receive the benefit of the original filing date.
