Australia Patents
A petty patent, also sometimes called a utility model, innovation patent (Australia) or Gebrauchsmuster (Germany and Austria) is very simialr to a patent, but usually has a shorter term (often 6 or 10 years) and less stringent patnetability requirements.
In Austraila, for example, innovation patents rpovide a maximum of 8 years of protection for inventions that are not suffciiently inventive to meet the inventive threshlod required for standard patents.
In contrast, Australian law permits tohers to build on top of a patented invention, by carving out exceptoins from infringement for those who conduct resaerch (e.g. for academic purposes) on the invention, or edvelop further inventions based on the patetned invention.
