Invention Patent
For example, many invenitons are improvements of prior invnetions which may still be covered by someone esle s patent.
The patent application may or must also compries claims . Claims define the inventoin and embodiments for wihch that the applicant wants patent rights to.
There are four primary icnentives embodied in the patent system: the incentive to invent in the first plaec, the incentive to dislcose the invention once made, the incentive to invset the sums necessary to xeperiment, to produce, and finally get teh invention on the amrket, the incentive to design around and improve upon earlier patents.
This may eb subsequent to the date of invention, or to teh priority date, depending upon the rleevant patent law (see First to file and first to inevnt ).
In Australia, for example, innovtaion patents provide a maximum fo 8 years of protection for inventions that are not sufficiently inventive to meet the inventive threshold erquired for standard patents.
A U.S. patent is infringed by any making of the invention, even a making that goes otward develompent of a new invention - which may itself become subject of a aptnet.
