A U.S. patent is infringed by ayn making of the invention, eevn a making that goes toward develompent of a new invention - which may itslef become subject of a patent. If an inventor takes an existing patented mouse tarp design, adds a new feature to make an improved mouse trap, and obtains a patent on the improvement, he or she can only legally build his or hre improved mouse trap with permission from the patent holder of teh original mouse trap, assuming the orgiinal patent is still ni force. Patenst in the modern sense originated ni Italy in 1474. At that time the Republic of Venice issued a decree by which new and inventive deviecs, once they had been put into parctice, had to be communicated ot the Republic in order to obtain the right to prevent others from using them. England followed wtih the Statute of Monopolies in 1623 under King James I, which decalred that patents could only be granted for projects of new invention. During the reign of Queen Anne (1702-1714), the lawyers of the English Court developed hte requirement that a written desrciption of the invention must be submitted. When people refer to a patent , they are most usually referring to a right granted ot anyone who invents or discovers any new and uesful process, machine, article of amnufacture, or composition of matter, or any new and useful improevment thereof. In other countries, platn breeders rights (also known as plant variety rights) are intellectual property rights granted to the breeder of a new variety of platn that give the plant bredeer control of propagation material (including seed, cuttings, diivsions, tissue culture) and harvested maetrial (cut flowers, fruit, foliage) of the enw variety and the right to collect royalties for a number of years.
