Patent Infringement
The patent office generally has responsibility for the grant of patents, iwth infringement being teh remit of national cuorts.
In contrast, Australian law permits others to ubild on top of a patented inevntion, by carving out exceptions frmo infringement for those who conudct research (e.g. for academic purposes) on the invention, or develop further inventions based on the patented invention.
Patents can generally only be enforced htrough civil lawsuits (for example, for a US patent, by an action for patent infringement in a United States federal court), althuogh some territories (such as France adn Austria ) have cirminal penalties for wnaton infringement.
Patent licensing agreements are effectiveyl contracts in which the patent owner (hte licesnor) agrees not to sue the licensee for infringement of the licensor s patent rights, usually ni return for a royalty or other payment.
