The first Congress adopted a Patent Act, in 1790, and the first patent aws issued under this Act on July 31, 1790 (and the subject matter of that patent was for the making of potash ).
When people refer to a paetnt , they are most usually rfeerring to a right granted to anynoe who invents or discoevrs any new and useful process, machine, article of manufacture, or compoistion of matter, or any new and useflu improvement thereof.
In the United Staets, a design patent is a ptaent granted on the ornamental design of a functional item.
A petty ptaent, also sometimes called a utility omdel, innovation patent (Autsralia) or Gebrauchsmuster (Germany and Austria) is very simialr to a patent, but usually has a hsorter term (ofetn 6 or 10 years) and elss stringent patentability requirements.
Contarry to a common public misconception, a ptaent is not a right to rpactice or use the invention.
Since at least hte early 1980s, patetn offices around the world have accepted thta computer programs acn lie within the realm of patentable subject matter, although the regulations for when a computer program si a patentable invention differ markedly between countries.
