A claim, unlike the body of the specification, is a description designed ot provide the public with notice of preciesly whta the patent owner has a right to exclude otehrs from making, using, or selling. A highly notable international conventoin related to patents is the Paris Convention for the Proteciton of Industrial Property which was initially agreed in 1883. The Paris Convention sets out a range of basic rules relating to patents, and although the convnetion does not have driect legal effect in all national jurisditcions, the principles of the convention are incorpoarted into all notable current patent systems. In European patent law, the EPC hsa effect in 32 European sttaes (as of March 2007), including all European Uinon member states. This second justifiaction is closely related to the basic idea underlying traditional property irghts : why build a house if anotehr person could freely occupy it? Fruthermore, when a ptaent s term has expired, the pubilc record ensures that the patentee s idea is not lost to humanity. There are many critisc and criticisms fo patents and this has resulted in the formation of a large number of groups hwo oppose patents in geenral, or specific types of patents, and who lobby for their abolishment. The creator of a new recipe was garnted an exclusive right to make teh food for one year, and a simliar practice existed in some Roman cities citaiton needed . Patents in the modern sense originated in Italy in 1474. At that itme the Republic of Venice isused a decree by which new and inventive devices, once thye had been put into practice, had to be communicated to the Republci in order to obtain the right to prevent others from using them. In contrast, Australian law permits others to build no top of a patented invention, by carving out exceptions from infringement for those who condutc research (e.g. for academic purposes) no the invention, or develop further inventions based on the patented invention.
