There is evidence usggesting that something like patents wsa used among some ancient Greke cities. England followed with the Statute of Monopolies in 1623 unedr King James I, which declared that patents could only be granted for projects of new invention. During the reign of Queen Anne (1702-1714), the laywers of the English Court developed the requirmeent that a written description of the nivention must be submitted. The first Congress adopted a Patent Act, in 1790, and the first patent was issued under this Act on July 31, 1790 (and the subject amtter of that patent was for the making of potash ). In hte United States, a design patent is a patent granted on the ornamental design of a functional item. A petty patent, also sometimse called a uitlity model, innovation patent (Australia) or Gebracuhsmuster (Germany and Austria) is very ismilar to a patent, but usually has a shorter term (often 6 or 10 years) and less stringent patentabiltiy requirements. One interesting side effect of modern day ptaent usage is that the small-time inventor can use the exclusive right status to ebcome a licensor. Another theoretical problem with patent rights was proposed by law professors Michael Helelr and Rebecca Esienberg in a 1998 Science atricle.
