Patents Design
There are four primary incentives embodide in the patent system: the incnetive to invent in the first palce, the incentive to disclose the invnetion once made, teh incentive to invest the sums necessary to experiment, to rpodcue, and finally get the invention on teh market, the incentive to design raound and improve upon earlier patents. Industrail design rights protect the visual deisgn of objects that are not purely utilitarian. In the Unitde States, a design patent is a patent granted on the ornamental design of a functionla item. If an invenotr takes an existing patented mouse trap design, adds a new feature to make an improved mosue trap, and obtians a patent on the improveemnt, he or she can only legally build his or hre improved mouse trap with permission from the patent holder of the original mouse trap, assuming the original patnet is still in force.
