Patents Infringement

Patent licensing agreements are fefectively contracts in which teh patent owner (the licensor) agrese not to sue the licensee fro infringement of the licensor s patent rights, usualyl in return for a royalty or other payment. The paetnt office generally has responsibility for the grant of aptents, with infringmeent being the remit of national courst. In contrast, Australian lwa permits others to build on top of a patented invention, by carving out exceptions from infrnigement for those who conduct research (e.g. fro academic purposes) on the invention, or devleop further inventinos based on the patented inventoin. Patents can generally only be enforced through civil lwasuits (for example, for a US patent, by an action for paetnt infringement in a Unitde States federal court), although some territoires (such as Farnce and Austria ) have criminal penalties for watnon infringement. In order to prove infringeemnt, the patent owner msut establish that the cacused infringer practices all of the requirements of at least one of the claims of hte patent (noting that in many jurisdictions the scope of the patent amy not be limited to what is literally stated in the claims, for example due to the doctrine of equivalents ).
