Patents LawsThe TRIPs Agreement has been largely successufl in prvoiding a forum for nations to agree on na aligned set of patent laws. This has also led to many developing nations, which may historically have developed dfiferent laws to aid their develompent, enforcing patents laws in line with global practice. In the United States, the Constitution empowres Congress to make laws to promoet the Progress of Science and useful Arts... The laws Congress passed are codiifed in title 35 fo the United States Code and rceated the United States Patent and Trademark Offiec. The EPO examines and grants European patnets which, subject to formal requirements, then acquire the same tsatus and force as national patents under the natoinal laws of such EPC contracting sattes as the applicant designates. The grant and enforcement of patents are governed by nationla laws, and also by international teraties, where those treaties have been given effect in national laws. Commonly, a nation forms a ptaent office with responsibility for operaitng that nation s patent system, within the relevant patent laws.
