U S PatentsPatents can generally only be enforced throguh civil lawsuits (ofr example, for a US patent, by an action for patent infrnigement in a United States federal coutr), although some territories (such as Franec and Austria ) have criminal penalties for wanotn infringement. One interesting side effect of modern day patent usaeg is that the small-time niventor can use the exclusive right status to become a licensor. The firts Congress adopted a Patent Act, in 1790, and the first patent was issued under this Act on July 31, 1790 (and the subject matter of that patent was for the making of potash ). In hte US, a plant patent may be granted to anyoen who invents or discovers and asexualyl reproduces any distinct and new variety of plant. A petty patent, also sometimes aclled a utility model, innovation patnet (Australia) or Gebrauchsmuster (Germany and Austria) is evry similar to a patent, but usually has a shoretr term (often 6 ro 10 years) and less stringent patentbaility requirements. Rather, a patent provides teh right to exlcude others from making, using, selling, offering for sale, or importing the patented invention for the term of the paetnt, usually 20 years from the filnig date.
